Parties:
This agreement is made between Villabenim.com (hereinafter referred to as the "Seller" or "Lessor") and the customer renting the villa online (hereinafter referred to as the "Buyer" or "Tenant") under the following terms and conditions.
Subject of the Agreement
This agreement regulates the rights and obligations of the parties concerning villa rental transactions made through Villabenim.com. By renting a villa online, the Buyer accepts all the terms and conditions of this agreement.
Approval and Validity of the Agreement
2.1. The Buyer declares that they have read and fully accept the terms of this agreement and agree to comply with the provisions while making a villa reservation online.
2.2. The agreement becomes valid when the Buyer makes a reservation to rent the villa and completes the payment transaction.
Payment and Refund Conditions
3.1. Payment:
The Buyer will pay the villa rental fee online via Credit Card or Bank Transfer. A portion of the rental fee will be collected at the time of booking, and the remaining balance will be paid upon check-in.
3.2. Cancellation and Refund:
Cancellation up to 30 days before: The Buyer will receive a full refund of the rental fee.
Cancellation 15-29 days before: The Buyer may receive 50% of the rental fee as a refund.
Cancellation 14 days or less: No refund will be made, and the full rental fee will be retained.
Cancellation requests must be made in writing via email to info@villabenim.com.
Tenant's Obligations
4.1. The Buyer agrees to use the villa solely for vacation purposes and comply with all the rules related to the villa during the stay.
4.2. The Buyer will act in a way that does not disturb the surrounding environment, harm neighborhood relations, and will use the villa's belongings carefully.
4.3. The Tenant must notify the Lessor of any damage to the villa and is responsible for compensating for any damages.
4.4. The Buyer agrees not to engage in any illegal activities within the villa.
4.5. The Buyer will not take possession of the villa outside the specified dates and will not share it with any other person or entity.
Seller's Obligations
5.1. The Seller will ensure that the rented villa is delivered to the Buyer on the specified dates.
5.2. The Seller will ensure that the villa is cleaned and maintained before delivery, making it ready for use.
5.3. The Seller will intervene immediately to repair any malfunction in the rented villa.
Right of Withdrawal from Distance Sales Agreement
Under the Consumer Protection Law No. 6502, the Buyer cannot exercise the right of withdrawal in the villa rental agreement since the holiday service starts on a specific date and ends quickly, making the right of withdrawal inapplicable. However, the legal cancellation and refund conditions remain valid.
Privacy and Personal Data
7.1. The Seller will use the Buyer’s personal data solely for the purpose of reservation and providing vacation services and will not share it with third parties.
7.2. The Buyer agrees that the personal information provided during the contract is accurate.
7.3. The Buyer is responsible for keeping their personal information up to date.
Resolution of Disputes
8.1. This agreement is governed by the laws of the Republic of Turkey.
8.2. In case of any dispute between the parties, the Courts and Enforcement Offices of Muğla will have exclusive jurisdiction.
Amendments to the Agreement
9.1. The Seller reserves the right to make changes to this agreement at any time.
9.2. Any changes made will only apply to new reservations and will not affect existing bookings.
